Wellet Terms of Service
Effective Date: April 21, 2026
Welcome to Wellet. These Terms of Service ("Terms") govern your use of the Wellet web application, available at getwellet.com and mywellet.com (the "Service"). Wellet is operated by Betsy Eble, a sole proprietor ("Wellet," "we," "us," or "our").
Please read these Terms carefully before creating an account or using the Service. By creating an account or using Wellet, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Agreement to Terms
By accessing or using Wellet, you confirm that:
- You are at least 18 years old;
- You have the legal capacity to enter into a binding agreement; and
- You agree to these Terms and our Privacy Policy.
If you are using Wellet on behalf of another person (such as a family member or loved one), you represent that you have the legal authority to do so.
2. Description of Service
Wellet is a Personal Health Record (PHR) application designed for family caregivers. It helps you organize, store, and understand health information for the people in your care — we call them your "care recipients."
Core features include:
- Storing and organizing health records, medications, appointments, and care notes for your care recipients;
- AI-powered features: "Ask Wellet" (conversational health Q&A) and "Update Me" (AI-generated care summaries);
- Care Circle: sharing health summaries with other trusted family members or caregivers (available on the Plus and Pro plans);
- EHR import: importing health records from electronic health record systems (available on the Pro plan).
Wellet is a care coordination and health information management tool. It is not a medical device, a healthcare provider, or an emergency service.
3. Medical Disclaimer
Please read this section carefully. It is important.
Wellet is not a medical service.
Wellet does not provide medical advice, diagnosis, or treatment. Nothing in the Service — including AI-generated content, care summaries, health record displays, or responses to your questions — constitutes or should be relied upon as medical advice.
The information in Wellet is intended to help you stay organized and informed so you can have better conversations with your loved one's doctors and care team — not to replace those conversations.
AI-generated content is not medical guidance.
The "Ask Wellet" and "Update Me" features use artificial intelligence to help you understand health information and prepare for medical appointments. AI-generated responses may be incomplete, inaccurate, or out of date. AI-generated content is never a substitute for the advice, diagnosis, or treatment of a qualified healthcare professional. Always consult a licensed healthcare provider before making any medical decision.
In a medical emergency, call 911.
If you believe someone is experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on Wellet or any information within it in an emergency. Wellet is not an emergency service and cannot summon help or contact emergency services on your behalf.
Your responsibility.
You are solely responsible for any decisions — medical or otherwise — made based on information you access, enter, or generate within Wellet. We strongly encourage you to consult qualified healthcare professionals for all medical decisions.
4. Account Registration and Security
Creating an account
To use Wellet, you must create an account. You agree to provide accurate, complete, and current information when registering and to keep that information up to date.
- Age requirement: You must be at least 18 years old to create an account.
- One account per person: Each person may maintain only one Wellet account. You may not create or use multiple accounts.
- Account security: Wellet uses magic links (one-time login links sent to your email) instead of passwords. You are responsible for keeping your email account secure. Do not forward magic links to anyone. You are responsible for all activity that occurs under your account.
If you believe your account has been compromised or accessed without your authorization, notify us immediately at support@getwellet.com.
Account suspension
We may suspend or terminate your account if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or created harm to other users or to the Service. We will make reasonable efforts to notify you before taking such action, except where immediate action is necessary to protect the Service or others.
5. User Responsibilities and Consent
Accuracy of information
You are responsible for the accuracy and completeness of the health information you enter into Wellet. We do not verify, validate, or fact-check the information you provide. Inaccurate information may be harmful — please take care to enter information correctly.
Consent from your care recipient
Before entering health information about another person into Wellet, you must have:
- The care recipient's consent, if they are a competent adult capable of giving it; or
- Legal authority to manage their health information (such as a healthcare power of attorney, guardianship, or similar authorization recognized under applicable law).
You represent and warrant that you have obtained all necessary consent or legal authority before entering another person's health information into Wellet. Wellet is not responsible for any unauthorized use or disclosure of another person's health information resulting from your failure to obtain appropriate consent or authority.
Compliance with laws
You are responsible for ensuring your use of Wellet complies with all applicable laws and regulations, including those governing privacy, health information, and caregiving in your jurisdiction.
Not for medical decision-making
You agree not to use Wellet as the sole or primary basis for any medical decision. Wellet is a tool to help you stay organized and informed — always consult a qualified healthcare professional before making medical decisions.
6. Care Circle and Shared Access
The Care Circle feature (available on the Plus and Pro plans) lets you share health summaries and care information with other trusted family members or caregivers ("Circle Members").
Your responsibilities when sharing
When you invite someone to your Care Circle:
- You confirm that you have the care recipient's consent (or legal authority) to share their health information with the people you invite;
- You are responsible for who you invite and what information they can access;
- You understand that once information is shared, you cannot control what a Circle Member does with it.
Circle Members' responsibilities
Circle Members agree to:
- Access shared information only for the purpose of providing care and support;
- Keep shared health information confidential;
- Not share, copy, or disclose information outside the Care Circle without consent.
Removing access
You can remove a Circle Member at any time. Once removed, they will no longer have access to new information, but we cannot guarantee that information already accessed has been deleted from their devices.
7. AI-Powered Features
Wellet offers two AI-powered features:
- Ask Wellet: A conversational interface where you can ask questions about health information, medications, conditions, and caregiving topics to help you prepare for appointments and understand your loved one's care.
- Update Me: An AI-generated summary of recent care activity and health changes, designed to help you quickly get up to speed on what's happening with your care recipient.
How to use AI features responsibly
- AI responses are informational only. They are meant to help you know what to ask the doctor — not to replace the doctor.
- AI responses may be incomplete, incorrect, or outdated. Always verify important information with a licensed healthcare professional.
- Do not use AI features in emergency situations. Call 911 in an emergency.
- The AI features do not have access to real-time medical databases and are not connected to your care recipient's healthcare providers.
No clinical decisions
Wellet's AI features are not clinical decision support tools. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. We expressly disclaim any liability for decisions made based on AI-generated content.
8. Subscription and Payments
Wellet offers the following subscription plans:

Billing
Paid subscriptions are billed annually. By subscribing, you authorize us to charge the applicable fee to your payment method at the start of each billing period.
Renewals and cancellations
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then.
Refunds
Subscription fees are generally non-refundable. If you believe you were charged in error, contact us at support@getwellet.com within 30 days of the charge and we will work with you to resolve it.
Price changes
We may change subscription prices at any time. We will give you at least 30 days' advance notice of any price increase. Continued use of a paid plan after a price change takes effect constitutes your acceptance of the new price.
Free plan limitations
The Free plan is provided without charge and may be modified, limited, or discontinued at our discretion with reasonable notice. Features available on the Free plan may change over time.
9. User Data and Ownership
You own your data
The health information you enter into Wellet belongs to you. Wellet claims no ownership over the personal health information, notes, or records you create in the Service.
Limited license to provide the Service
By using Wellet, you grant us a limited, non-exclusive, revocable license to access, store, process, and use your data solely to:
- Provide and operate the Service for you;
- Deliver AI-powered features (Ask Wellet, Update Me);
- Send you notifications and summaries related to your care activity;
- Improve the reliability, security, and performance of the Service.
We will not sell your health information to third parties. We will not use your health information for advertising purposes. Our full data practices are described in our Privacy Policy.
Data export
You can export your data at any time through your account settings. We provide data export in a portable format so you can take your information with you.
Data deletion
You can request permanent deletion of your data at any time through your account settings or by emailing privacy@getwellet.com. When you request deletion, 100% of your data — including any data imported from non-VA sources (such as MyChart exports, PDFs, or other EHR imports) — will be permanently and irreversibly deleted within 45 days of your request, following the 30-day grace period described in Section 17. The only exception is data we are legally required to retain (for example, limited records for fraud prevention or to comply with a lawful order), as described in our Privacy Policy.
10. Intellectual Property
Wellet's property
Wellet owns all rights, title, and interest in and to the Service, including:
- The software, code, and infrastructure underlying the Service;
- The Wellet brand, logos, trademarks, and trade dress;
- The design, look and feel, and user interface of the Service;
- All content created by Wellet, including documentation, marketing materials, and feature descriptions.
Nothing in these Terms transfers any Wellet intellectual property to you. You may use the Service only as permitted by these Terms.
Your property
As described in Section 9, you retain full ownership of the health information and content you enter into Wellet. Wellet's license to your data is limited to what is necessary to provide the Service.
Feedback
If you share ideas, suggestions, or feedback about Wellet ("Feedback"), you grant us a perpetual, royalty-free license to use that Feedback to improve the Service. We will not identify you as the source of Feedback without your permission.
11. Acceptable Use
You agree to use Wellet only for its intended purpose as a personal health record and care coordination tool. You agree not to:
- Enter false, misleading, or fraudulent information;
- Use Wellet to store information about someone without their consent or your legal authority to do so;
- Attempt to reverse-engineer, decompile, or extract the source code of the Service;
- Use automated tools, bots, or scripts to access or interact with the Service without our written permission;
- Use the Service to store or transmit content that is unlawful, harmful, or violates any third party's rights;
- Attempt to gain unauthorized access to any part of the Service or another user's account;
- Use the Service in any way that could damage, disable, or impair the Service or interfere with other users;
- Circumvent or attempt to circumvent any security or access control features of the Service;
- Use the Service for any commercial purpose not expressly authorized by us, including reselling or sublicensing access.
We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate this section.
12. Service Availability and Modifications
"As is" availability
We work hard to keep Wellet available and reliable, but we do not guarantee uninterrupted access. The Service is provided "as is" and "as available." We are not liable for any downtime, outages, or service interruptions, whether planned or unplanned.
Changes to the Service
We may add, modify, or remove features at any time. We will provide advance notice of significant changes — especially changes that remove features you may rely on — through the Service, by email, or both. Where practicable, we will give at least 30 days' notice before discontinuing a core feature.
Data export before changes
If we discontinue a feature that stores your data, we will provide you with a reasonable opportunity to export that data before it is removed.
Planned maintenance
We may take the Service offline for maintenance from time to time. When possible, we will schedule maintenance during low-traffic hours and notify you in advance.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
Wellet's total liability to you for any claim arising out of or related to these Terms or your use of the Service — whether based on contract, tort, negligence, strict liability, or any other theory — is limited to the greater of:
- The total fees you paid to Wellet in the 12 months immediately preceding the event giving rise to the claim; or
- $25.00.
In no event will Wellet be liable for:
- Indirect, incidental, consequential, special, exemplary, or punitive damages;
- Loss of data, loss of profits, or loss of business;
- Medical decisions made based on information in the Service, including AI-generated content;
- Actions taken or not taken by you or any healthcare provider based on information in Wellet;
- Unauthorized access to your account or data caused by your failure to secure your credentials;
- Damages resulting from service interruptions, outages, or loss of access.
These limitations apply even if Wellet has been advised of the possibility of such damages, and even if any limited remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability. To the extent those laws apply to you, some of the above limitations may not apply.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Wellet provides the Service "as is" and "as available," without warranties of any kind — express, implied, or statutory.
We specifically disclaim all implied warranties, including:
- Warranties of merchantability or fitness for a particular purpose;
- Warranties that the Service will be uninterrupted, error-free, or secure;
- Warranties that information in the Service (including AI-generated content) is accurate, complete, reliable, or current;
- Warranties that the Service will meet your specific needs or produce particular results.
We make no warranty that Wellet is appropriate for medical use, clinical decision-making, or any purpose requiring professional healthcare judgment.
Some jurisdictions do not allow disclaimer of implied warranties. To the extent those laws apply to you, some of the above disclaimers may not apply.
15. Indemnification
You agree to defend, indemnify, and hold harmless Wellet and its owner, officers, agents, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service in violation of these Terms;
- Your violation of any law or regulation;
- Your violation of any third party's rights, including privacy rights;
- Your failure to obtain appropriate consent or legal authority before entering another person's health information into Wellet;
- Any misrepresentation you make in connection with your use of the Service.
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.
16. Dispute Resolution
Informal resolution first
If you have a dispute with us, please contact us first at support@getwellet.com and give us a chance to resolve it. Most problems can be resolved quickly and informally, and we are committed to working with you in good faith.
Binding arbitration
If we cannot resolve a dispute informally within 60 days, any remaining dispute, claim, or controversy arising out of or relating to these Terms or the Service — including any question of arbitrability — will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the State of North Carolina, or remotely, at your election.
By agreeing to these Terms, you and Wellet waive the right to a jury trial and the right to litigate disputes in court, except as provided below.
Exceptions
Arbitration is not required for:
- Claims that qualify for small claims court in your jurisdiction; or
- Requests for injunctive or equitable relief to protect intellectual property rights or prevent irreparable harm.
No class actions
You agree that disputes will be resolved only on an individual basis. You waive any right to bring or participate in a class action, class arbitration, or representative proceeding. If this class action waiver is found unenforceable in a particular case, the arbitration requirement will not apply to that case.
Governing law
These Terms and any disputes arising from them are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any court proceedings permitted under these Terms will be brought in the courts of North Carolina.
17. Termination
Your right to terminate
You may delete your account at any time through your account settings. Account deletion is subject to a 30-day grace period, during which your account is deactivated but your data is retained and you may reactivate. After the grace period, 100% of your data — including any imported non-VA data — will be permanently and irreversibly deleted within 45 days of your original deletion request.
We encourage you to export your data before deleting your account.
Our right to terminate
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms;
- We believe your use of the Service poses a risk to other users, the Service, or third parties;
- We are required to do so by law.
Where possible, we will give you advance notice and an opportunity to export your data before terminating your account for cause. In cases of serious or ongoing violations, we may act without notice.
Effect of termination
Upon termination:
- Your right to use the Service ends immediately;
- Your data will be available for export for 30 days after termination;
- After the grace period, 100% of your data (including non-VA data) will be permanently deleted within 45 days of termination, except as required by law or our Privacy Policy.
Survival
The following sections survive termination of these Terms: Section 3 (Medical Disclaimer), Section 9 (User Data and Ownership), Section 10 (Intellectual Property), Section 13 (Limitation of Liability), Section 14 (Disclaimer of Warranties), Section 15 (Indemnification), Section 16 (Dispute Resolution), and this Section 17.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Post the updated Terms on the Service with a new effective date;
- Notify you by email or in-app notice at least 30 days before the changes take effect (for material changes).
If you continue to use the Service after the updated Terms take effect, you accept the new Terms. If you do not agree to the changes, you may delete your account before the new Terms take effect.
For minor, non-material changes (such as correcting typos or clarifying language without changing substance), we may update the Terms without advance notice.
19. SMS Messaging Terms
These SMS Messaging Terms apply to text messages sent by Wellet to phone numbers entered into the Service through the Wellet Connect invitation feature.
Program name: Wellet Connect
Program description: Wellet Connect sends one-time invitation SMS messages to family members and loved ones whose phone numbers are manually entered into the Wellet app by an existing Wellet user. Recipients receive a short link to accept the invitation and create their own Wellet account. A reminder may be sent if the invitation is not accepted.
Message frequency: Variable. Most recipients receive 1–2 messages total (an initial invitation and an optional reminder). Wellet Connect is not a recurring marketing program.
Message and data rates: Message and data rates may apply. Standard carrier rates apply to all messages sent to or received from Wellet.
Opt-out: You may opt out of all Wellet SMS messages at any time by replying STOP to any message. After replying STOP you will receive one confirmation message and no further messages will be sent to your number.
Help: Reply HELP to any Wellet message for support, or email support@getwellet.com.
Carriers: Carriers are not liable for delayed or undelivered messages.
Privacy: Phone numbers submitted to Wellet for the purpose of sending invitations are handled in accordance with the Wellet Privacy Policy. Wellet does not sell, rent, or share phone numbers with third parties for marketing purposes. SMS delivery is provided by our messaging vendor, Twilio.
